Enterprise Captives.

How the program works.
The program is intended for organizations that assume a defined portion of risk, commit to multi-year participation, actively participate in program governance, and comply with established loss prevention and risk management protocols
Insurance policies are issued by licensed primary insurers, with a defined portion of risk retained through the Captive structure and additional protection provided through reinsurance
Unlike traditional insurance, program results are more directly influenced by Members’ loss experience and risk characteristics, subject to program terms, governance, and reinsurance arrangements
Each Member also becomes a Subscriber of the Reciprocal Insurance Exchange a commercial insurer and reinsurer owned by its policyholder Subscribers
The Reciprocal is administered by an independent Attorney-in-Fact (AIF) pursuant to delegated authority, with oversight provided by a Subscribers Advisory Committee, subject to the Subscribers’ Agreement
Reinsurance Structure
- eMaxx Reciprocal Insurance Exchange (“Reciprocal”) is a commercial insurance company and reinsurer owned by its policyholders (“Subscribers”)
- Day-to-day operations are managed by Attorney-in-Fact (“AIF”), with oversight by a Subscribers Advisory Committee
- By joining the eCaptiv program, each Member also becomes a Subscriber of the Reciprocal
- The primary insurer cedes risk to the Reciprocal, net of its retained layer
- The Reciprocal retrocedes losses to the Captive up to the applicable per-occurrence retention, net of its retained layer
- The Reciprocal supports Excess of Loss (XOL) reinsurance above the Captive layer
- Where applicable, Members are charged a provisional rate for XOL reinsurance, with potential assessment adjustments based on actual loss experience
- Reinsurance structure differs by Captive
- Each Member executes a Reciprocal Insurance Exchange Subscribers Agreement along with the eCaptiv Membership Agreement and Limited Guaranty Agreement
Available Coverage Lines
- Commercial Automobile
- General Liability
- Workers Compensation
- Excess Liability
- Commercial Property
- Inland Marine
